Blogging Terms of Service Terms of Service   Description of Service   For the purpose of this document, The Logo List, LLC, The Logo List Blog, and http://www.thelogolist.com is referred to as “The Logo List”, and all users of the site are referred to as “you”, “your”, or “member.”   Please make sure that you read these Terms of Service (“TOS”) carefully before using this site. These Terms of Service apply throughout the site. By using this site, you acknowledge your agreement with these Terms of Service. If you do not agree with any of the below Terms of Service, do not use this site. The Logo List reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms of Service at any time and your continued use of the site following the posting of changes to these terms will mean you accept those changes. In order to use The Logo List and The Logo List Blog, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access.  In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. Member Conduct Violations of the TOS may result in the termination of access to The Logo List’s  services or deletion of content without notice. You will not upload, post, transmit, transfer, disseminate, distribute, or facilitate distribution of any content, including text, images, sound, data, information, or software, that:   incites, advocates, or expresses pornography, obscenity, vulgarity, profanity, hatred, bigotry, racism, or gratuitous violence. misrepresents the source of anything you post, including impersonation of another individual or entity. provides or create links to external sites that violate this TOS. is intended to harm or exploit minors in any way. is designed to solicit, or collect personally identifiable information of any minor (anyone under 18 years old), including, but not limited to: name, email address, home address, phone number, or the name of their school. invades anyone's privacy by attempting to harvest, collect, store, or publish private or personally identifiable information, such as passwords, account information, credit card numbers, addresses, or other contact information without their foreknowledge and willing consent. Intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission or any rules of any national or other securities exchange; including but not limited to child pornography, illegal drugs, copyright material and intellectual property not belonging to you. is intended to threaten, stalk, defame, defraud, degrade, victimize, or intimidate an individual or group of individuals for any reason; including on the basis of age, gender, disability, ethnicity, sexual orientation, race, or religion; or to incite or encourage any one else to do so. intends to harm or disrupt another user's computer or would allow others to illegally access software or bypass security on Web sites, or servers, including but not limited to spamming. attempts to impersonate a Logo List employee, agent, manager, host, another user, or any other person through any means. Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals.  This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons, and creating “Crush” sites. upload, post or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements). upload, post or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party. upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. interfere with or disrupt the service or servers or networks connected to The Logo List or disobey any requirements, procedures, policies or regulations of networks connected to The Logo List. Content All of the content you place on The Logo List Blog is public.  The Logo List may quote or reproduce small portions of your content in order to promote The Logo List and The Logo List Blog, but only on a fair-use-type basis. The information and opinions expressed on the site are not necessarily those of The Logo List and The Logo List makes no representations or warranties regarding that information or those opinions. Furthermore, neither The Logo List nor its content providers are responsible or liable to any person or entity whatsoever (including, without limitation, persons who may use or rely on such data/materials or to whom such data/materials may be furnished) for any loss, damage (whether actual, consequential, punitive or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based upon or resulting from any information or opinions provided on The Logo List. You acknowledge that The Logo List does not pre-screen content, but that The Logo List shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the service. Without limiting the foregoing, The Logo List shall have the right to remove any content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. Indemnity You agree to indemnify and hold The Logo List, and its officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your blog, your use of The Logo List or Logo List Blog, your connection to the service, your violation of the TOS, or your violation of any rights of another. No Resale of Service You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of The Logo List, use of The Logo List, or access to The Logo List. Modifications The Logo List reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, The Logo List Blog (or any part thereof) with or without notice. You agree that The Logo List shall not be liable to you or to any third party for any modification, suspension or discontinuance of The Logo List Blog. Termination You agree that The Logo List, in its sole discretion, may terminate your password, account, use of The Logo List Blog, and remove and discard any content within The Logo List Blog, for any reason, including, if The Logo List believes that you have violated or acted inconsistently with the letter or spirit of the TOS. The Logo List may also in its sole discretion and at any time discontinue providing The Logo List Blog with or without notice. You agree that any termination of your access to The Logo List Blog under any provision of this TOS may be effected without prior notice, and acknowledge and agree that The Logo List may immediately delete your blog, account, and all related information and files and/or bar any further access to such files or The Logo List Blog. Further, you agree that The Logo List shall not be liable to you or any third-party for any termination of your access to The Logo List Blog. Employment By creating an account, commenting to or posting blogs to The Logo List, including those bloggers considered “Resident Bloggers”, in no means qualifies you as an “employee” of The Logo List.  No posted blog or blogger is paid or given any form of compensation for any blog content on The Logo List.  By posting blogs to The Logo List, you agree that the service is completely voluntary and no relationship exists between you and The Logo List. Disclaimer YOU EXPRESSLY UNDERSTAND AND AGREE THAT: ·         YOUR USE OF THE LOGO LIST BLOG IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE LOGO LIST EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. ·         THE LOGO LIST MAKES NO WARRANTY THAT THE LOGO LIST  WILL MEET YOUR REQUIREMENTS, THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE LOGO LIST WILL BE ACCURATE OR RELIABLE, THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE LOGO LIST WILL MEET YOUR EXPECTATIONS, AND ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. ·          ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE LOGO LIST IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. ·         NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE LOGO LIST OR THROUGH OR FROM THE LOGO LIST SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS. ·          IF YOU HAVE READ THIS FAR THEN YOUR EYES PROBABLY HURT. Rights and Responsibilities We encourage you not to share information that others could use to harm you, and for parents to be aware of and help exercise control over content posted by and activities of their children to keep them safe online. The Logo List is not responsible for the content or activities in any Logo List Blog. The decision to view or engage all content is yours and we advise you to use your judgment.
